FAQ
Introduction
An oversize load needs more than a permit. It also has to warn other drivers that something wide, long, or tall is coming. In New Mexico, that warning comes from the right signs and flags in the right places.
The rules are specific. They set the size of the sign, the color, the height of the letters, the size of the flags, and exactly where each one goes. A load that carries a valid New Mexico Oversize Permit but has the wrong signs or missing flags is still out of compliance. This guide explains the requirements in 18.19.8 NMAC so your load is marked correctly before it rolls.
The Short Answer
Under 18.19.8.34 NMAC, oversize signs shall be properly affixed on the front and rear of all oversize vehicles, combinations or loads. Each sign must be at least five feet wide by twelve inches high, with a bright yellow background and black lettering, and letters at least one inch wide by ten inches high.
Under 18.19.8.33 NMAC, an oversize vehicle, combination or load shall be properly flagged at all times, with red, fluorescent red, or fluorescent orange flags measuring no less than eighteen inches on any one side.
Oversize Sign Requirements
Section 18.19.8.34 sets the sign rules for every load moving on a New Mexico Oversize Permit:
-
Wording: the sign reads "OVERSIZE," "OVERWIDTH," "OVERLENGTH," or "OVERHEIGHT."
-
Size: at least 5 feet wide by 12 inches high.
-
Colors: bright yellow background with black lettering.
-
Letters: at least 1 inch wide by 10 inches high.
-
Location: on the front and rear of the vehicle, combination, or load.
A small sign, faded colors, or thin lettering can make the sign hard to read from a distance, which defeats its purpose.
Where the Signs Go
Front sign. Under 18.19.8.34(C), the front sign goes on the front of the foremost vehicle or on top of the cab of the power unit in the foremost position. It must be visible and must not block the clearance lights.
Rear sign. Under 18.19.8.34(D), the rear sign goes on the rear of the load or the rearmost vehicle, where it is clearly visible to motorists.
Make sure nothing hides the signs, such as chains, straps, the load itself, or a ladder rack.
Flag Requirements
Section 18.19.8.33 covers flags:
-
Always flagged: the load must be properly flagged at all times during the move.
-
Colors: red, fluorescent red, or fluorescent orange.
-
Shape: square or rectangular.
-
Size: no less than 18 inches on any one side.
Flags mark the widest and farthest points of the load, so other drivers can judge its true size.
Flag Placement on a Single Vehicle
For a single vehicle, 18.19.8.33(C) requires:
-
Front and rear flags fastened to each corner of the vehicle at the widest points.
-
Side flags marking any part that sticks out wider than the front or rear.
-
Overhang flags for a front overhang of 3 feet or more and a rear overhang of 4 feet or more, with a flag on each corner of the extreme point of overhang, or one flag if the overhang is less than 2 feet wide.
Flag Placement on a Combination
For a tractor and trailer, 18.19.8.33(D) requires flags on:
-
The front corners of the power unit.
-
All four corners of the trailer or load.
-
The sides, at any extremity wider than the front or rear.
-
Overhangs, for a front overhang of 2 feet or more and a rear overhang of 4 feet or more.
Note that the front overhang trigger is 2 feet for combinations but 3 feet for single vehicles.
Signs, Flags, and Lights on Escort Vehicles
If your New Mexico Oversize Permit requires escorts, the escort vehicles have their own rules under 18.19.8.88 NMAC:
-
Sign: bright yellow, at least 5 feet wide by 12 inches high, with black lettering reading "OVERSIZE LOAD."
-
Flags: no less than 12 inches on any one side.
-
Lights: two rotating, flashing, strobe, or LED amber lights on top of the vehicle, visible at least 500 feet in normal sunlight.
Under 18.19.8.20(B), an escort that is not certified must remove or cover its signs and remove the amber lights and flags before the check at the port of entry.
Manufactured Homes
Manufactured homes follow 18.19.8.65 NMAC:
-
Signs: a yellow sign reading "WIDE LOAD" or "OVERSIZE LOAD" on the front of the towing unit and the rear of the home.
-
Flags: red or fluorescent orange, no less than 18 inches on any side, at each corner of the home and each front corner of the towing vehicle.
-
Lights: two roof-mounted amber lights on the towing unit and at least one on the rear of the home.
Common Mistakes to Avoid
-
Using a sign that's too small. It must be at least 5 feet by 12 inches.
-
Short letters. Letters must be at least 10 inches high.
-
Only one sign. You need signs on both the front and rear.
-
Small or faded flags. Load flags must be at least 18 inches on a side and red or orange.
-
Forgetting overhang flags. Front and rear overhangs need their own flags.
-
Covering clearance lights. The front sign must not block them.
